Terms of Service

1. Acceptance of Terms

By accessing or using Agent Wars (“the Game”), registering an account, or clicking “Sign Up,” you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use this service. These Terms constitute a binding legal agreement between you and Nicolas Chaillan / In the Nic of Time (“we,” “us,” or “our”).

2. Eligibility

You must be at least 13 years of age to use this service. By registering, you represent and warrant that you meet this requirement. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Email Communications & Marketing

By creating an account, you expressly consent to receive email communications from In the Nic of Time, including:

  • Episode announcements and live event invitations
  • Weekly newsletters and cybersecurity insights
  • Game updates, new features, and maintenance notices
  • Promotional content related to In the Nic of Time and affiliated products

You may unsubscribe from marketing emails at any time via the unsubscribe link in any email. Transactional emails (account verification, password reset) are not subject to unsubscribe requests.

4. User Accounts

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must provide accurate and truthful registration information.
  • Usernames and scores may be publicly displayed on leaderboards.
  • You may not share, sell, or transfer your account to another person.
  • One account per person. Multiple accounts for competitive advantage are prohibited.

5. Prohibited Conduct

You agree NOT to:

  • Cheat, exploit bugs, use automation scripts, bots, or unauthorized third-party tools
  • Attempt to hack, reverse-engineer, or disrupt the game or its infrastructure
  • Harass, threaten, or abuse other users
  • Submit false, misleading, or offensive content
  • Attempt to access other users' accounts or data
  • Engage in any activity that violates applicable law

6. Intellectual Property

All game content, artwork, card designs, game mechanics, text, and branding are the exclusive property of Nicolas Chaillan / In the Nic of Time. You may not reproduce, distribute, modify, or create derivative works without express written permission. Your gameplay data and submitted content may be used by us for analytics, improvement, and promotional purposes.

7. Privacy & Data

We collect and store your email address, username, and gameplay data (scores, game history, session data) for the purpose of operating the game and sending you communications you have consented to. Your data is:

  • Stored securely on servers located in the United States
  • Never sold to third parties
  • Shared only with service providers (e.g., email delivery) strictly for operating this service
  • Retained for the lifetime of your account; you may request deletion by contacting us

By registering, you consent to this data collection and processing as described. If you are located in the European Economic Area, you have additional rights under GDPR including the right to access, correct, and delete your personal data.

8. Disclaimer of Warranties

THE GAME IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. YOUR USE OF THE GAME IS AT YOUR SOLE RISK.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE GAME, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, SCORES, OR GAME PROGRESS. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

We are not responsible for: (a) score loss due to technical failures; (b) account termination for violations of these Terms; (c) any actions taken by other users; (d) downtime, maintenance, or service interruptions.

10. Account Suspension & Termination

We reserve the right to suspend or permanently terminate any account at our sole discretion, with or without notice, for: violations of these Terms, cheating, abusive behavior, or any conduct we determine to be harmful to the service or community. Terminated accounts forfeit all game progress, scores, and data.

11. Service Availability

We make no guarantees regarding the availability, uptime, or continuity of the game. We reserve the right to modify, suspend, or discontinue the service at any time without liability. Game scores and progress are not guaranteed to be preserved indefinitely.

12. Changes to Terms

We may update these Terms at any time. Continued use of the service after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email to registered users.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Orange County, Florida. You waive any objection to venue or jurisdiction in such courts.
